Franchising

Sherman & Howard's Business and Corporate Practice Group represents both franchisees and franchisors in all aspects of their business operations, including helping them address whether franchising is the best way to expand an operation. We represent franchisors in developing, operating, and expanding their franchise concepts, nationally and internationally - from preparing franchise agreements and related documentation to registering state by state, making FTC disclosures and terminating franchise agreements where appropriate. We also regularly represent franchisees in evaluating the purchase of a franchise, negotiating franchise and other agreements, and addressing any difficulties that might arise in the franchise relationship. Our franchisee and franchisor clients can also draw upon our firm's general corporate, contract, international business, employment, tax, trademark and intellectual property, antitrust, dispute resolution and litigation resources as necessary. We have represented clients with a variety of operations throughout the world, including sports teams, restaurant and entertainment businesses, building supply companies and a variety of other retail goods and service providers.
