• Represented creditors in filing and prosecuting involuntary bankruptcy petitions against businesses.
• Lead counsel for committees of unsecured creditors in a variety of Chapter 11 cases, including a publicly traded computer software company, a telecommunications company, an Arizona water utility, a furniture retailer and a $50 million ponzi scheme.
• Lead counsel for bankruptcy trustee in case of prime contractor for several public works construction projects throughout the southwestern United States.
• Represented regional and national homebuilders in a variety of Chapter 11 proceedings.
• Represented homeowner in confirming Chapter 13 plan, opting out of class action settlement and litigating predatory lending claims against subprime mortgage servicer.
• Represented former officer of bankrupt public company in connection with claims against directors and officers liability insurance policy.
• Filed class action against officers and directors of Chapter 11 debtor, resulting in payment by directors and officers liability insurance policy.
• Represented bankruptcy trustee in pursuing recovery of preferential and fraudulent transfers.
• Prosecuted or defended complaints objecting to discharge and/or dischargeability of certain debts.
• Represented landlords of Chapter 11 debtors in several prominent cases, including K-Mart, Hollywood Video, Sizzler Restaurants, the Shane Co. and Super-X of Arizona.
• Represented parties to a variety of executory contracts, including franchise agreements, real estate sales contracts and joint development agreements.
• Represented purchasers of real estate and other assets from bankruptcy estates.
• Estate planning for solvent individuals and families with net assets in excess of $3 million.
