Representative Matters

• Represented major secured lender (in excess of $70 million) in receivership and bankruptcy of premier spa and golf resort
• Represented municipality in obtaining dismissal of adversary proceeding filed by debtor to set aside foreclosure of real property and recover $15 million of alleged damages, which dismissal was affirmed by the District Court and the Ninth Circuit Court of Appeals
• Represented lender in asserting its rights and remedies against borrower and others arising out of multi-million fraud in construction of bottling plant, including repossession and liquidation of equipment
• Represented a lender in the foreclosure of a golf course, pro shop, restaurant and community center in Arizona, including the appointment of a receiver and exercise of other pre-judgment remedies
• Represented major financial institution in two related bankruptcy cases in Arizona in connection with complex fraud litigation pending in California
• Represented working capital secured creditor of general contractor in successfully recovering entire indebtedness from contractor's surety
• Counseled numerous defendants in fraudulent transfer and preference proceedings in bankruptcy
• Represented several secured creditors and purchasers in asset sales in bankruptcy
